Artificial intelligence is software – delivered via the cloud, like SaaS, or as an on-premise system. So most of its terms should be familiar to experienced tech contracts drafters. However, the most sophisticated forms – generative AI like ChatGPT – have features unlike any other software. We’ll look at those differences and the new terms they require. And we’ll look at commonalities with traditional software deals, so we can ground ourselves in the familiar.
