Customer warrants that: (a) it has and will collect the Customer Data in compliance with all applicable laws, including without limitation laws on privacy, security, and disclosure of personal information; and (b) it has and will obtain such consents as are required by applicable law for Provider to access and process the Customer Data as authorized by to this Agreement.

Provider warrants that: (a) it employs and will employ industry standard or better protections to prevent unauthorized disclosure of or access to personally identifiable information Customer provides to the System; and (b) it will comply with those laws governing the privacy and security of such information and generally applicable to data processors in the jurisdictions in which Provider does business. (Such laws do not include, without limitation, any law to the extent that it is specific to Customer’s industry.)
